Support when representing yourself in Family Court

Always remember, it is your child's right to see you; therefore, even if the resident parent refuses to allow this then it is likely that you will have to go to court.

This is the only way to legally see your child, and the court can award you a Child Arrangements Order. This is a mandatory order which the resident parent CANNOT refuse, meaning they must obey by it, and you can see your child by law.

Going to court can be expensive and there have been changes in the last few years, and many people no longer get legal aid, even if they are on benefits; however it is always worthwhile to check with a legal advisor if you may still get financial help.

You must pay a £240 court fee to get a child arrangements order. If you're on a low income, or in receipt of benefits, you could get help with the fees if you use link: www.gov.uk/get-help-with-court-fees


Please note that the Court may refuse your application if you have not had mediation, please take a look at the following link to see if you might be exempt:

www.familymediationcouncil.org.uk/find-local-mediator. There is also a recent government scheme to help with this cost, please take a look to see if you are entitled.
